B-1 Visa:  Business Vistors

 

Overview of B-1 Visa:

 

The B-1 business visitor visa allows businesspersons to enter the United States on relatively short notice.

The Immigration and Nationality Act of 1952  

Pub. L. No. 82-414, 66 Stat. 163 (codified as amended at 8 USC §§1101-1537).

(INA) describes the B visa as such:

An alien (other than one coming for the purpose of study or performing skilled or unskilled labor or as a representative of foreign press, radio, film, or other foreign information media coming to engage in such vocations) having a residence in a foreign country, which he has no intention of abandoning and who is visiting the United States temporarily for business or temporarily for pleasure.

 

B-1 Visa Requirements:

 

There are three basic requirements to the B-1 Visa. The requirements are based on securing the visitors intent to return home. Since the B-1 is for temporary and short visits, the U.S. Immigration officials are seeking assurance that the visitor will return prior to their home country prior to expiration of the visa. The three requirements are:

 

  1. Unabandoned foreign residence: US immigration wants to have proof that the B-1 visitor has a home or dwelling in their home country that they intend to return to.
  2. Entry for Temporary Period: US immigration requires that there be an intent of time limitation in the stay and that the stay is not indefinite.
  3. Permitted Business Activities: Under the B-1 visa, visitors are allowed to engage in business, but may not engage in local employment or labor for hire. Meaning, the B-1 visa holder may enter for the purpose of conducting business affairs related to their business in their home country, but may not enter for the purpose of gaining new local employment in the U.S.
